YONKERS WILL GET SCREWED AGAIN: State lawmakers annually argue over how much money should go toward Yonkers Public Schools, but this year, officials are expecting a $6 billion deficit and that’s likely to make for the worst Foundation aid battle ever.

EXTRA MONEY: Foundation Aid is a funding formula that sends extra dollars to high-needs districts like #Yonkers

CHILDREN CHEATED: A lawsuit prompted the creation of the #FoundationAid formula a dozen years ago, but since then it has largely not been funded to the level promised.

When the state sends money to #NewYork school districts, a majority of it is funneled through Foundation Aid.

State education officials, who this year are asking for a $2 billion increase in education dollars, contend that the state still owes districts a total $3.7 billion in Foundation Aid

#WestchesterCounty Senator Shelley Mayer, who co-chairs the Senate’s education committee, held a series of discussions throughout the state this fall to examine whether the 12-year-old formula should be tweaked.

But as Yonkers state lawmakers, like J Gary Pretlow lobby for more education dollars, the state is facing down a $6 billion deficit, the largest in nearly in a decade.

Yonkers has a different partner in the Senate now, with Andrea Stewart-Cousins being elected majority leader.

Former educator and Yonkers Assemblyman Nader Sayegh has said Foundation Aid continues to be the top priority, and then trying to build steps to address the inequity in the formula.

However, #NewYork Governor Andrew Cuomo, who has increased education spending over his time in office, has said the Foundation Aid lawsuit is a long-settled matter that doesn’t bind him to any set spending boost.

Governor Andrew Cuomo prefers not to increase spending more than 2% from the previous year.

It will be interesting to see how this all plays out in the next legislative session in #Albany, but things don’t look good for The City of Yonkers or Mayor Mike Spano‘s budget in 2020.

FEDS ARE IN YONKERS: The Department of Justice accused three men associated with a subcontractor, carpentry company CWC Contracting, of paying hundreds of thousands of dollars in bribes and kickbacks.

In return, the department alleged, the bribed employees would pad Mount Vernon carpentry firm CWC Contracting’s bottom line by awarding contracts and approving change orders.

Twelve people, most allegedly associated with the Gambino crime family, were charged in the case, which stemmed from a sting operation.

Scarsdale resident and alleged captain of the Gambino crime family, Andrew Campos was arrested and he is rumored to have many connections with Yonkers insiders.

Court papers show how Campos, his partner Richard Martino, and a host of underlings allegedly dispensed bribes, kickbacks and violent threats while under FBI surveillance.

But except for the alleged mob figures, the feds did not name many names in their 56-page indictment other than John Simonlacaj, a former development executive at HFZ Capital Group.

The 50-year-old Scarsdale resident has been fired from HFZ, where he was managing director of development.

Simonlacaj pleaded not guilty Friday to wire fraud conspiracy and tax fraud and was released after posting $250,000 bail.

The latest indictment charged a dozen defendants, including alleged members of the Gambino crime family from the Bronx and Westchester.

Simonlacaj’s cousin Mark “Chippy” Kocaj and the alleged mobsters ran a carpentry firm, CWC Contracting, that paid hundreds of thousands of dollars in kickbacks and bribes to employees of numerous construction and development companies.

Federal investigators said they heard partner, Mark “Chippy” Kocaj, saying the CWC Contracting Corp did $50 million a year

The alleged bribes took place between between June 2018 and June 2019.

The indictment alleged that employees at other real estate firms — “Company #2” and “Company #3” — also received kickbacks from CWC Contracting.

Those firms and other employees went unnamed in the document, though it did say that Company #2 has a site in Yonkers and another in White Plains.

On CWC’s website, the company highlighted eight New York projects it said it worked on. Developers of those projects included RXR Realty and Extell Development.

Along with the $21.3 million in tax breaks, Extell is also secured a Payment in Lieu of Taxes, or PILOT, agreement with the city, in which it would make a flat payment every year.

PUBLIC MEETING: On December 11th the developer of the proposed Lionsgate Movie Studio on Wells Avenue near the Metro-North Railroad station in downtown Yonkers appeared before the city’s planning board.

DOWNTOWN YONKERS: Planning Board Chairman Roman Kozicky said the application is in and Lionsgate’s plans are in and the movie studio was quickly was working with city staff on some traffic and Yonkers Fire Department issues.

WATERFRONT REVIEW: The City of Yonkers is hoping the environmental quality review requirements in terms of lead agency completed by the end of December.

The planning board is expected to review the project again at its meeting scheduled for Jan. 1

There is a separate application to build a 363-car parking deck on top of the nearby Kawasaki Rail Car plant, because construction of the movie studio building would wipe out current grade-level parking.

Previously, The parking area on the roof of Kawasaki was approved by this board back in 2011 and was extended for a two-year term.

There would be no public parking permitted on the rooftop deck and it is uncleafr how many public parking space would be lost.

The parking deck would take six to nine months and the Lionsgate movie studio itself 12 to 18 months.

PUBLIC NOTICE

A GENERAL ORDINANCE AMENDING THE CODE OF THE CITY OF YONKERS BY ADDING A NEW CHAPTER 37 ENTITLED “PLASTIC STRAW FREE YONKERS”

Notice is hereby given that the City Council of the City of Yonkers has adopted the abovementioned legislation that seeks to reduce the use of plastic straws, except upon request by customers.  The penalty for violation of this ordinance is as follow:

§ 37-5 Penalties.

Any Covered Establishment found to be in violation of the provisions of this Chapter, shall be liable for a civil penalty. Such a penalty will be imposed upon the findings of an investigation by the City of Yonkers Consumer Protection Bureau following notice of a potential violation. Such a penalty will be payable to the City of Yonkers pursuant to the following penalty structure:

  1. Any Covered Establishment found to be in violation of the provisions of this law a first time shall be issued a written warning.

B. Any Covered Establishment found to be in violation of the provisions of this law a second time shall be liable for a civil penalty not to exceed $100.00.

C. Any Covered Establishment found to be in violation of the provisions of this law a third time shall be liable for a civil penalty not to exceed $250.00.

D. Any Covered Establishment found to be in violation of the provisions of this law a fourth time shall be liable for a civil penalty not to exceed $500.00.

E. For each subsequent violation, daily fines of $100.00 shall be instituted and applied for violations of this Chapter until compliance is achieved.

All fines collected for violations of this Chapter shall be used to offset any costs of compliance and oversight of adherence to this Chapter or to address the costs to the City associated with waste removal and recycling.

PEARL HARBOR: Hy Seiden was still a young man, stationed in tropical paradise and dozing on his U.S. Army-issued cot on a beautiful December morning when exploding bombs shook the ground beneath him.

The screaming whine of Japanese dive bombers, the fearsome thunder of enemy Zeros strafing scattering servicemen, pushed Yonkers, N.Y. native Hy Seiden to his feet and out of his tent at Fort Kamehameha, an Army base adjacent to Pearl Harbor, Hawaii.

Breakfast would have to wait. It was Dec. 7, 1941, and the world was about to change forever.

He found a jeep somewhere, drove to the armory and shot the lock off. The experience colored much of Hy Seiden’s life after the war.

The attack on Pearl “should be remembered so that the generations that are growing up now know that freedom is not free,” Hy Seiden once said said at a veteran’s event.

“Freedom has a price that has to be paid, and many of the soldiers who protected that freedom paid the ultimate price.”

YONKERS TRIBUNE: MGM’s President and COO in Yonkers Steps Down from MGM Resorts International Empire City Casino

BRIAN HARROD: MGM Resorts International President and COO Uri Clinton of Empire City Casino in Yonkers who had been lobbying New York lawmakers has stepped down from the firm.

That he is no longer president of the company’s billion dollar casino in the City of Hills was confirmed by MGM late Monday.

Uri Clinton — the most visible MGM Resorts International executive resigned his post as president and chief operating officer of MGM Empire City in New York, less than a year after taking the job.

In an email to the Hartford Courant, MGM added: “However, he continues to support our development efforts as a consultant.”

Mayor Mike Spano has yet to comment over this unexpected news.There is much unfinished business to contend with in the upcoming 2020 session with Senate Majority Leader Andrea Stewart-Cousins and Yonkers’ Assembly Gaming Chairman J, Gary Pretlow.

MGM Resorts named Clinton president and COO of Empire City about a year ago, shortly before closing on its $850 million purchase of the property, which includes Yonkers Raceway.

Spectrum Gaming Group Chosen to Study New York Gambling Market In An Effort To Help Downstate Casinos Like MGM Get Full Casino Licences

MGM Resorts International also wants expanded gaming at its Yonkers, New York Empire City Casino in 2020 or 2021

The #SpectrumGamingGroup of Horsham, Pennsylvania was selected by the New York State Gaming Commission to undertake a statewide market study.
The contract for the study still required final approval by the office of state Comptroller Thomas P. DiNapoli and #Yonkers‘ Assembly Gaming Committee Chairman, J Gary Pretlow, pushing hard for it.

The study will look at several key questions on New York State gaming. For instance, is there a market for additional casinos in #NewYork State and what impact new venues may have on existing casinos upstate.

The consultant will focus strongly on metropolitan #NewYorkCity area, where MGM Resorts at Yonkers Raceway is itching to spend another billion bucks.

But the study will supposedly consider the impact of sports betting and online wagering, legal gambling in neighboring states, and the impact of #TribalCasinos on New York State commercial casinos.

In 2013, Governor Andrew Cuomo approved a constitutional amendment to allow four full-gaming commercial casinos in upstate New York.

MGM Resorts International also wants expanded gaming at its Empire City Casino in #YonkersNY.

In January, #MGMResorts closed on a deal to acquire #EmpireCity for $850 million from the #RooneyFamily.

#MGM has attempted to get #NewYorkState officials to allow downstate casinos licenses before 2023, when a current moratorium is set to end.

MGM wants the Yonkers property to become a traditional casino sometime next year or in 2021 and has the support of Yonkers Senate Majority Leader Andrea Stewart-Cousins, Yonkers State Senator Shelley Mayer and Yonkers Assemblymen Nader Sayegh and J Gary Pretlow.

In March, MGM and another venue, Resorts World Casino New York City, located in #Queens and operated by Genting, both offered $500 million in licensing fees for expanded gaming.

They also could pay upstate casinos, which are struggling financially.

Empire City is home to 5,200 slot machines and electronic games.

Empire City’s electronic offerings include blackjack, three-card poker and roulette.

But the establishment does not yet feature live table versions of those games.

Yonkers Mayor Mike Spano says MGM wants to build one of its world class entertainment convention center venues on the 97 acre property.

But everyone wants in on this #NYC Area Casino Gold Rush, as the money losing Suffolk Regional Off-Track Betting (#OTB) is once again attempting to open a contentious gaming venue in #Medford.

#SuffolkOTB recently filed initial documents to undertake an environmental impact study on placing a 160,000-square-foot video lottery gaming venue at the site of the former #Brookhaven Movie Theater.

Three years ago, residents voiced strong opposition to the plan.

The pressure was a key reason the proposal failed, but now there is a chance at full casino gambling at the site.

The location of the proposed casino is on eastern Long Island, some 61 miles from #Manhattan.

PRESS RELEASE: On Thursday, November 28th, 2019, at approximately 5:20 PM, members of the Yonkers Police Department responded to 47 Yonkers Avenue at the Oak Street intersection on a report of a motor vehicle having struck a pedestrian.

YONKERS: Upon arrival First Responders located an unresponsive elderly female down in the street in apparent cardiac arrest and immediately began cardiopulmonary resuscitation; she was transported to a local area hospital with severe bodily injuries where she was pronounced deceased. Police cordoned-off the accident scene and initiated a criminal investigation.

Police Detectives and investigators from the Major Case Squad, Crime Scene Unit, and Accident Investigation Unit responded to the scene, interviewing subjects and witnesses, recovering surveillance video, processing forensic evidence, and reconstructing the events of the accident.

Investigation thus far has yielded that the victim, identified as 77-year-old Po Yol Han, a resident of Nepperhan Avenue, was crossing Yonkers Avenue north to south when she was struck by an early model pick-up truck that was traveling westbound on Yonkers Avenue; the truck stopped for several minutes before fleeing the scene.

Several hours later investigators located a vehicle of interest parked and unoccupied less than a mile away, and are actively working to identify the responsible parties. Surveillance video capturing the accident was also recovered as evidence.

HIGH TECH SCAM: Imtiyaz Siddiqi allegedly called subscribers using various telephone numbers from a variety of area codes that displayed the Dish name on caller ID screens.

FAKE ACCOUNTS: Dish Network said Imtiyaz Siddiqi used aliases, such as “Richard Bates” or “Terry James,” the complaint states, and he also used agents to make calls on his behalf.

SOUTHERN DISTRICT NEW YORK: Dish Network Sues Yonkers Man And District Judge Vincent Briccetti Grants Summary Judgment

Dish Network says a Yonkers man has posed as a company representative to trick customers into paying him for unnecessary services.

Dish, a satellite pay-television provider based in Englewood, Colorado, sued Imtiyaz Siddiqi for $2 million in federal court in White Plains on May 17.

Siddiqi orchestrated a telemarketing scheme, the complaint states, “for the purpose of extracting payments from Dish’s subscribers.”

Dish claims that Siddiqi has been defrauding its customers since at least early 2016.

The scam, as described in the complaint, rested on three key steps.

First, he had to persuade customers that if their equipment were not upgraded or adjusted, at their expense, they would lose television programming. He instructed them to email questions to dishnetwork@consultant.com, “further conveying his false association with Dish.”

Second, he had to trick Dish into dispatching a technician, the complaint states, “to impart an air of legitimacy to his scheme.” So he allegedly called the company while posing as subscribers asking for upgrades or equipment adjustments.

Third, he would recontact subscribers “again and again demanding payment and threatening to shut off their Dish services if payment was not made.”

He instructed customers to send payments to a Yonkers post office box, according to the complaint, or pay by credit card or debit card.

The scam worked hundreds of times, the complaint claims, and typically netted $150 per incident. In some cases, Dish installed new equipment.

Sometimes, the subscriber terminated the contract.

In reality, the callers were masquerading as Dish agents and the addresses to which the callers told Dish’s subscribers to mail payments both belong to Imtiyaz Siddiqi.

The lawsuit does not explain how Siddiqi identified Dish subscribers.

The evidence was so strong that the court granted plaintiff’s unopposed motion for partial summary judgment on its contributory trademark infringement claims, determining that defendant knew or was willfully blind to the fact that the callers were infringing plaintiff’s DISH marks, and still continued to prove payment processing services for an infringing purpose.

In addition, the court found that defendant participated in, and shared control over, the scheme to use the DISH marks to turn a profit.

The Yonkers Planning and Development department contracted with Specialty Construction Systems to fabricate the 13 bike racks and is installing them in various locations throughout the city including:

· City Pier (Foot of Main Street)

· 2 S. Broadway· Nepperhan Avenue and New Main Street

· Palisade Preparatory School (201 Palisade Ave.)

· Riverdale Avenue at Main Street (24 Main Street)

· Yonkers Greenway Playground (1 Wolffe Street)

· Riverdale Avenue at Cerrato Park (50 Vark Street)

· S. Broadway at Vark Street (155 S. Broadway)

· Dock Street and Woodworth Avenue

· Grinton I. Will Library (1500 Central Park Avenue)

· S. Broadway and McLean Avenue

· Kimball Avenue and Glen Washington Road

While each rack is distinct in its curve, all of the racks have the same color scheme — phosphorescent paint to light up at night on the outside, blue on the inside and hot pink on the edge.

The (WH)eels bike racks complement the Yonkers Greenway Initiative, which is the proposed 2.4 mile trail that will run along the former Putnam Railroad, from Van Cortlandt Park at the Bronx border through southwest Yonkers, and ultimately connecting to the Yonkers Train Station and the Hudson River.

Funding for the new bike racks is provided by a grant from the NYSERDA Clean Energy Communities Program and from the Yonkers Community Development Agency.

CULTURE WARRIOR: Yonkers City Council Man Anthony Merante will be introducing a resolution to henceforward refer to City of Yonkers “Tree Lighting” ceremonies as “Christmas Tree Lighting”

YONKERS: A meeting of the Community Services Committee has been scheduled ‎for Tuesday, November 26th at 4:30P.M. in the Council Chambers, #Yonkers‎ ‎City Hall, 4th floor to consider Resolution 2019 being proposed by 6th District Councilman #AnthonyMarante.

The resolution calls for full respectful recognition of religious holidays by referring to them by their proper names.

By way of illustration, a “Holiday” Tree Lighting would be referred to as a “Christmas” Tree Lighting; a “Holiday” Menorah Lighting would be referred to as a “Chanukah” Menorah Lighting; a “Holiday” Kinara Lighting would be referred to as a “Kwanzaa” Kinara Lighting in order to recognize the individual faith communities that gave rise to the respective celebrations and traditions that are at the heart of these events that are widely anticipated and open to everyone to appreciate and enjoy.

Councilman Anthony Merante noted, “There is a great deal of cultural and religious diversity in the City of Yonkers, and Yonkers is home to many houses of worship encompassing Christianity, Judaism, Islam and other faiths and beliefs. I believe all religious holidays should be fully acknowledged by there proper names. In truncating or diluting them is disrespectful to their tradition. Christians celebrate Christmas with a Christmas tree. So when doing a lighting it should be referred to as a Christmas tree lighting in all the promotional aspects of the event.”

This legislation would impact only The City of Yonkers‘ official events and those of its departments and subsidiary agencies.

LOWER THE CURTAIN: Caustic Theater Critic John Simon Has Passed

Eminent critic John Simon distinguished career, which began in 1949 when he wrote a review for the out-of-town tryout of Tennessee Williams’ “A Street Car Named Desire” in The Harvard Advocate

IN MEMORIAM; John Simon, a theater and film critic, Who wrote for Hezi Aris‘s Yonkers Tribune and Sam Zherka‘s #WestchesterGuardian has died at age 94.

ACID TONGUED CRITIC: #JohnSimon known for his lacerating reviews and often withering assessment of performers’ physical appearance.

He died Sunday night at Westchester Medical Center.

Simon served as the chief theater critic at New York magazine for nearly 40 years before being dismissed in 2005.

He then worked at Bloomberg for five years before being fired in 2010.

Later his tart and curmudgeonly were featured in Westchester publications.

He also reviewed for New York’s Channel 13, but was forced out, because the station considered his notices misanthropic.

Time magazine called Simon “the most poisonous pen on Broadway.”

He once compared Kathleen Turner to “a braying mantis.”

One actress fought back, Sylvia Miles dumped a plate of pasta on his head when she encountered him in a restaurant.

In 1981, an ad in Variety appeared accusing John Simon of being “racist, anti-Semitic, misogynist, vicious, and derisive.” It was signed by 300 artists.

Brent Spiner on Twitter recalled being described by the critic “like a good high school actor in a bad college production.”

John Simon defended his sharp elbows, arguing that the theater was becoming dumbed down.

In 1969, the New York Drama Critics Circle voted to refuse him membership.

The following fall, the body relented and allowed him in.

The circle also voted to keep him in the group in 2010 when he technically was no longer working for a publication published in New York City, part of the group’s bylaws.

From 1950-1955, Simon taught at Harvard, the University of Washington and M.I.T.

He also taught at Bard College and the University of Pittsburgh in the 1960s.

His articles appeared in everything from Town and Country to Esquire and the Weekly Standard.

He was the author or editor of over a dozen books, including “Uneasy Stages,” a collection of his reviews from 1963 through 1973, and “John Simon on Theatre,” which included the next three decades.

Other books include “John Simon on Music” and “John Simon on Film.”

Simon was born in Yugoslavia in 1925 and received his B.A. in English, as well as his master’s and Ph.D. in comparative literature from Harvard University. He was a George Polk Award winner and was a Fulbright Fellow.

On his blog, he also continued to annoy.

In one of his blog posts in 2013, he defended his toughness because he cared.

“A critical sting is not like a slight flesh wound, treatable with ointment. If intentionally negative, it has to sting. This is the only way it is noticeable, the only way it could make a difference. That is to say if any criticism makes a difference.”

In his last post just before Halloween, he wrote: “One person’s critic is another person’s crackpot.”

The Julia Dyckman Andrus Memorial – also known as the Andrus Children’s Center – is a private non-profit community agency offering services to children in Yonkers

The facility in Yonkers helps children with severe emotional, behavioral and mental health issues suffered from a fire Sunday night.

There is no word on how the fire started or if anyone was injured, but the Yonkers Fire Department responded around 8 pm and say that he flames were apparently contained to a maintenance shed on the property.

Three Men Robbed A Yonkers Livery Cab Driver At Knifepoint In Harlem

A Group of individuals entered a Livery Cab in Yonkers headed to 125th Street and Lenox Avenue in in the Harlem neighborhood of Manhattan.

The NYPD say that’s when a dispute broke out over whether or not the driver could break a $100 bill.

That dispute escalated when one of the suspects allegedly displayed a knife and took $1,500 in cash from the driver before leaving the scene.

The NYPD has sent out the above surveillance image of the three people sought in connection to the robbery.
